KENYATAAN MEDIA BERKENAAN PELAKSANAAN AKPS (Dwibahasa)

Kerajaan Negeri Sabah melalui Mesyuarat Jemaah Menteri Sabah telah meneliti isu-isu semasa berhubung pelaksanaan Agensi Kawalan Penguatkuasaan Sempadan (AKPS) di Sabah, bahawa terdapat elemen penghakisan kuasa-kuasa serta hak keistemewaan imigresen Sabah melalui sifat perundangan dan pengoperasian imigresen.
Pelaksanaan AKPS ini akan mengambil alih peranan Jabatan Imigresen Malaysia Negeri Sabah di pintu-pintu masuk Sabah, di mana Pihak Berkuasa Negeri tidak mempunyai kuasa langsung (direct) ke atas AKPS, tetapi hanya melalui Pengarah Imigresen Negeri Sabah seperti yang diperuntukan di bawah subseksyen 6(3) Akta Agensi Kawalan dan Perlindungan Sempadan Malaysia 2024 [Akta 860]. Selain itu, Kerajaan Negeri Sabah turut mengesan percanggahan antara Akta 860 dan Akta Imigresen 1959/63 [Akta 155] yang boleh menjejaskan kelancaran dan kesempurnaan tugas penguatkuasaan di pintu-pintu masuk Negeri Sabah.
Perlu ditegaskan bahawa kuasa autonomi imigresen kepada Sabah dan Sarawak merupakan kuasa yang tidak boleh dirunding (non-negotiable) kerana implementasi penubuhan Malaysia di bawah Malaysia Agreement 1963 (MA63) adalah tertakluk kepada penggubalan kuasa autonomi imigresen Sabah dan Sarawak.
Oleh yang demikian, Kerajaan Negeri Sabah memutuskan untuk menangguh dasar dan pelaksanaan AKPS di Sabah sehingga memperolehi persetujuan bahawa tidak ada sebarang penghakisan kepada hak istemewa serta kuasa-kuasa autonomi imigresen Sabah dan Pihak Berkuasa Negeri. Justeru, menjamin perlindungan kedudukan dari segi perlembagaan (constitutional safeguard) mengenai negeri Sabah sentiasa terpelihara.

The Sabah State Government, through the Sabah State Cabinet Meeting, has examined the current issues related to the implementation of the Malaysia Border Control and Protection Agency (AKPS) in Sabah, noting that there are elements of erosion of Sabah’s powers and special immigration rights through the legal and operational nature of immigration enforcement by AKPS.
The implementation of AKPS is intended to take over the role of the Sabah State Immigration Department at Sabah’s entry points, whereby the State Authority will not have direct power *s* over AKPS, but only through the Sabah State Immigration Director as provided under subsection 6(3) of the Malaysian Border Control and Protection Agency Act 2024 [Act 860]. In addition, the Sabah State Government has also identified inconsistencies between Act 860 and the Immigration Act 1959/63 [Act 155], which could affect the implementation and effectiveness of enforcement duties at Sabah’s entry points by AKPS.
It must be stressed that immigration autonomy powers for Sabah and Sarawak are non negotiable, as the implementation of the formation of Malaysia under the Malaysia Agreement 1963 (MA63) is expressly subject to the establishment of Sabah and Sarawak’s autonomous powers over immigration.
Therefore, the Sabah State Government has decided to defer the policy and implementation of AKPS in Sabah until assurances are obtained that there will be no erosion of the State’s special rights and autonomous powers over immigration, as well as the authority of the State Government in this matter. This is to ensure that the constitutional safeguard regarding the position of Sabah over immigration continues to be protected at all times.
